These Terms of Use (the “Terms”) apply to the EX5 Wallet app for iOS, Android, Windows and macOS (the “App”), the website ex5wallet.com (the “Website”) and the services we provide through them (the “Service”). By creating an account, you agree to these Terms.
1. Who we are
1.1. The Service is provided by EX5 CRYPTO EXCHANGE sp. z o.o., Aleja Jana Pawła II 61/212, 01-031 Warszawa, Poland, entered in the National Court Register by the District Court for the Capital City of Warsaw in Warsaw under KRS 0001121024, NIP 5214081211, REGON 529358189, share capital PLN 5,000.00 (“EX5”, “we”, “us”).
1.2. You can contact us at info@ex5.com. How we handle personal data is explained in our Privacy Policy.
2. The Service
2.1. EX5 Wallet lets you receive, hold and send digital assets through your EX5 Wallet account. The supported assets and networks are shown in the App and in the table in Section 8.
2.2. Opening and keeping an account is free. Balances do not earn interest. We do not give investment, tax or legal advice; prices and charts in the App come from third parties and are for information only.
2.3. On the Website you can also sign up, free of charge, for e-mail updates about upcoming products and unsubscribe at any time using the link in any e-mail.
2.4. You need a device with a supported version of iOS, Android, Windows or macOS, internet access and an e-mail account.
3. Who can use the Service
3.1. You must be at least 18 years old, have full legal capacity and act on your own behalf and for your own account.
3.2. You may have only one account. It is personal and may not be sold, transferred or shared.
3.3. Our agreement is concluded when you complete registration (e-mail address, password, acceptance of these Terms and e-mail confirmation) and runs for an indefinite period.
3.4. We may ask for information needed to check that you meet the conditions in Sections 3 and 4, such as your country of residence or nationality. If you do not provide it or do not meet them, we may refuse or restrict the Service.
4. Restricted countries and sanctions
4.1. The Service is not available to persons who live in, or use the Service from:
- (a) the Member States of the European Union, Iceland, Liechtenstein and Norway;
- (b) the United Kingdom, the United States of America, Canada, Japan, the Republic of Korea, Indonesia, Israel, the Philippines, South Africa, the United Arab Emirates, Bahrain, Hong Kong, Thailand and mainland China;
- (c) the Russian Federation and the Republic of Belarus;
- (d) Cuba, Iran, North Korea and Syria;
- (e) Crimea, the city of Sevastopol and the areas of the Donetsk, Kherson, Luhansk and Zaporizhzhia oblasts of Ukraine not controlled by the Government of Ukraine;
- (f) any other country or territory subject to comprehensive sanctions of the European Union or the United Nations.
4.2. The Service may also be unavailable elsewhere. You are responsible for complying with the laws of the place where you are. Being able to download the App or open an account does not mean the Service is offered to you. We may take into account the country indicated by your IP address.
4.3. You may not use the Service if you, or a person you act for, are subject to sanctions of the European Union, the United Nations or Poland. Under EU sanctions (Council Regulations (EU) No 833/2014 and (EC) No 765/2006), the Service is also not available to nationals of Russia or Belarus, wherever they live, unless they are also nationals of, or hold a residence permit in, an EU or EEA country or Switzerland.
4.4. If you move to a restricted country, you must tell us and transfer your balance out. If your country is added to the list, we will notify you at least 30 days in advance, unless the law requires faster action.
4.5. We may refuse or suspend a send or deposit, or suspend your account, if we have reasonable grounds to believe that this Section has been breached or that a transaction involves a sanctioned person or address.
5. Your account and security
5.1. Give accurate information and keep access to your registered e-mail address; we send account notices there.
5.2. Keep your password, PIN, two-factor authentication (2FA) codes and devices secure and never share them. We will never ask for them. Install the App only from official app stores or the Website and beware of phishing: check that you are on ex5wallet.com before entering any data.
5.3. 2FA must be on before you can send, and every send is confirmed with a 2FA code. For your protection, sending is paused for 24 hours after a password reset and after 2FA is turned on for an account that holds a balance.
5.4. If you turn on Face ID, Touch ID or fingerprint unlock, anyone whose biometrics are registered on your device may be able to unlock the App.
5.5. You can review and sign out your devices in the App. If you suspect unauthorised access, change your password and contact us at once. We may block sign-in or sending until the matter is clarified.
5.6. You are responsible for sends confirmed with your password and 2FA code, unless they result from a breach of our systems or other circumstances for which we are responsible.
6. Receiving digital assets
6.1. Use only the deposit address shown in the App for that asset and network. A deposit is credited after the number of network confirmations shown in the App.
6.2. Unsupported assets, or assets sent on a different network, are not credited and may be lost permanently. We are not obliged to recover them, but where this is technically possible and safe we may try at your request, after agreeing the costs with you.
6.3. Deposits below the minimum deposit amount are not credited automatically; write to info@ex5.com and we will credit them. If an amount is credited to you by mistake, we may reverse it and will tell you why.
7. Sending digital assets
7.1. Before you confirm a send, the App shows the asset, network, destination address, sending fee and the amount the recipient will receive. Confirming with your 2FA code instructs us to carry out the send.
7.2. You are responsible for the destination address and network; we do not check them. Assets sent to a wrong address or on a network the recipient does not support are usually lost for good.
7.3. Blockchain transactions cannot be cancelled or reversed once broadcast. Before that, you may ask us to cancel a send at info@ex5.com; if it has not been broadcast yet, we return the amount and fee to your balance.
7.4. Minimum amounts and limits are shown in the App. Sends above the automatic 24-hour limit, or flagged by our security checks, are reviewed by our team first and may take longer. Confirmation times depend on the network.
7.5. We may refuse, delay or cancel a send if the law or an authority requires it, if we reasonably suspect fraud, unauthorised access or a breach of these Terms, if the address is linked to sanctions or illegal activity, or if the network is not working properly. Unless the law prohibits it, we will tell you why, and the amount and fee are returned to your balance.
7.6. If a network changes, for example through a fork, we decide whether to support any resulting asset and may pause that network for as long as security requires.
8. Fees
8.1. Opening an account and receiving assets are free. Each send has a fixed sending fee per asset and network, charged in the asset you send. It covers the network fee we pay and our charge, and does not depend on the network fee actually paid.
8.2. The fee that applies is the one shown in the App before you confirm. The table shows fees and minimum amounts on the date stated beneath it.
| Asset | Network | Sending fee | Minimum send | Minimum deposit |
|---|---|---|---|---|
| Bitcoin (BTC) | Bitcoin | 0.000047 BTC | 0.000141 BTC | 0.0001 BTC |
| Ethereum (ETH) | Ethereum | 0.0009 ETH | 0.0027 ETH | 0.001 ETH |
| Tether (USDT) | TRC-20 · Tron | 2.22 USDT | 6.66 USDT | 10 USDT |
| Tether (USDT) | ERC-20 · Ethereum | 2.04 USDT | 6.12 USDT | 10 USDT |
| USD Coin (USDC) | ERC-20 · Ethereum | 2.2781 USDC | 6.8343 USDC | 5 USDC |
| TRON (TRX) | Tron | 3.0815 TRX | 9.2445 TRX | 10 TRX |
Sending fees and minimum amounts as at . The fee for a send is shown in the App before you confirm it.
8.3. We may change sending fees when network fees, asset prices or our providers’ charges change. A changed fee applies only to sends confirmed after it is shown in the App. A new type of fee requires a change to these Terms.
9. Prohibited use
9.1. You must not:
- (a) use the Service for any illegal purpose, including fraud, money laundering or evading sanctions;
- (b) deposit assets that come from crime or to which you are not entitled;
- (c) give false information, use another person’s account or open an account for someone else;
- (d) provide unlawful content, for example in send notes or address book entries;
- (e) interfere with or test the security of the App, the Website or our systems, or use bots or scripts without our consent;
- (f) use the Service to provide services to others.
10. Suspension, termination and account deletion
10.1. We may restrict or suspend your account, or individual features, while the reason lasts if you seriously breach these Terms, if the law or an authority requires it, if we reasonably suspect fraud or unauthorised access, if Section 3 or 4 applies, or for security or maintenance. Where the law and security allow, you can still transfer your balance out.
10.2. We may end our agreement with 30 days’ notice if we discontinue the Service, or its provision in your country, or if the law or an authority prevents us from providing it, and immediately for a serious or repeated breach of these Terms or if you do not meet Section 3 or 4. We will tell you why, unless the law prohibits it. We then transfer your balance to an address you name, unless the law prohibits it.
10.3. You can end the agreement at any time, free of charge, by deleting your account in the App or by writing to info@ex5.com from your registered e-mail address. In the App, your balances must be zero and no transaction may be in progress; balances worth up to USD 1 that are too small to send can be given up. See Account deletion.
10.4. If you are a consumer, you may also withdraw from the agreement within 14 days of registration without giving a reason, in the same way. Completed sends cannot be reversed and their fees are not refunded; we send any remaining balance to an address you name without a sending fee.
11. Risks and liability
11.1. Digital asset prices are highly volatile and can fall to zero. Networks can be congested, fail, fork or be attacked, and token issuers (for example of USDT or USDC) can freeze or change their tokens. You decide how to use your assets and are responsible for your taxes.
11.2. We are liable for performing our agreement in accordance with the law. We are not liable for loss caused by an address, network or amount you entered; by others using your credentials or device because you did not keep them secure; by networks, forks or token issuers; by market price changes; by measures we take under these Terms; or by events beyond our reasonable control, unless the loss results from our failure to act with due care. If you are not a consumer, our liability does not include lost profits.
11.3. Nothing in these Terms limits liability for intentional damage, or any liability or consumer right that cannot be limited under mandatory law.
12. Changes
12.1. We aim to keep the Service available but cannot guarantee uninterrupted access, and may pause it for maintenance or security. Keep the App up to date; older versions may stop working.
12.2. We may add, change or remove features and supported assets. If a change affects you negatively, or we stop supporting an asset, we will notify you at least 30 days in advance, unless network events or the law require faster action. While the agreement is in force, you can always send your balance to an external address.
12.3. We may change these Terms for important reasons, such as changes in the law, security, changes to the Service or its costs, or to correct errors. We will e-mail you and publish the new Terms on the Website at least 30 days before they take effect, unless the law requires otherwise or the change is only in your favour. If you do not agree, you can delete your account free of charge before then.
13. Licence and app stores
13.1. The App, the Website and the EX5 name and logo belong to EX5 or its licensors. While our agreement is in force, you may use the App on devices you own or control to use the Service (a personal, non-exclusive, non-transferable licence). You may not copy, modify or reverse-engineer the App, except as permitted by law.
13.2. If you downloaded the App from the App Store or Google Play, the store’s terms also apply. Apple and Google are not parties to our agreement and are not responsible for the App, its support or any claims relating to it.
14. Complaints, governing law and contact
14.1. Send complaints to info@ex5.com with your registered e-mail address, a description of the issue and, for a transaction, its hash or date and amount. We reply by e-mail within 14 days.
14.2. These Terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you habitually live and may bring proceedings before its courts; you may also use out-of-court dispute resolution if both parties agree. Disputes with non-consumers are resolved by the court competent for our registered office.
14.3. These Terms are also available in Turkish, Russian and Polish. In case of discrepancy, the English version prevails.
14.4. We send notices to your registered e-mail address or in the App. If a provision is invalid, the rest remain in force. This version applies from the “Last updated” date above. Contact: EX5 CRYPTO EXCHANGE sp. z o.o., info@ex5.com.
